Rebecca Giblin

Dr Rebecca Giblin began her career working as a technology consultant within enterprises in the UK and Australia before obtaining a first class honors degree in law. After working as a lawyer in public and private practice, Rebecca returned to the academy and was awarded a PhD for her doctoral research on secondary liability for copyright infringement in 2008.

She is the author of a number of international and national publications on the subjects of copyright and global technology regulation, including a number of opinion pieces in the broadsheet press. Her book, "Code Wars: 10 years of P2P software litigation", was published by Edward Elgar in 2011. Code Wars recounts the legal and technological history of the first decade of the P2P file sharing era, focusing on the innovative and anarchic ways in which P2P technologies evolved in response to decisions reached by courts with regard to their predecessors. With reference to US, UK, Canadian and Australian secondary liability regimes, this book develops a compelling new theory to explain why a decade of ostensibly successful litigation failed to reduce the number, variety or availability of P2P file sharing applications – and highlights ways the law might need to change if it is to have any meaningful effect in future. Rebecca is currently working on a number of exciting new projects, including an exploration of the way in which factual compilations and databases should be protected under the Australian law, law reform proposals relating to the treatment of "jailbreaking" across multiple jurisdictions, and research into potential ways in which copyright might be reformulated to give greater rights and emphasis to authors (as opposed to owners) as a way of combating large scale infringement. In 2011, Rebecca was the Kernochan Center Visiting International Intellectual Property Scholar at Columbia Law School.
